Mediation Normally Involves Four Stages:
The Initial Consultation involves the Mediator explaining the process of Mediation to both sides by phone. There is no fee involved for this introductory service
Pre-mediation involves the Mediator speaking separately to the parties to get their individual perspectives on the dispute and to obtain some relevant background information. This can be done face to face or by phone. At this point parties are invited to sign an Agreement to Mediate covering confidentiality and other aspects of the mediation process.
The Mediation Session itself is where the Mediator brings the parties together (physically or online) to facilitate them finding a resolution to the dispute that satisfactorily meets the needs of both sides.
Post-mediation involves the Mediator preparing a final Mediation Agreement for consideration by the Parties.
(NOTE: Not all mediations go through all of these stages – every mediation session is different and will be guided by the nature of the dispute, the wishes of the parties and the approach taken by the Mediator.)
Fees and Charges
Mediators fees are charged at the hourly rate of €80. These fees cover all mediation interactions including phone calls, emails, online and face to face mediation sessions. A guide price for a fully completed mediation process would be between €300 to €500 for most mediations. Costs can vary, however, depending on the complexity and length of the mediation required. For example, costs for complex commercial cases are likely to be higher.
Costs outlines are provided prior to mediation in the Agreement to Mediate to reduce any worry for the parties. Where several sessions are required reduced fees can be agreed. All of the above fees are inclusive of any preparatory work undertaken by the Mediator.
In most cases fees and charges are shared by the parties and paid to the mediator by cheque/cash or electronic transfer on the day. In more complex cases the mediator may advise at the outset that additional hours may be required for the mediation and will give an estimate of likely costs.
The only additional costs that may be involved would be the cost of renting a room for all-party mediation sessions (on average hotels charge between €50 and €100 for a half day room hire).
